SALES AND SERVICES:

An order will be considered valid only after acceptance by DISFRUTA TU BAÑO.

Any modification to the order must be made in writing. Any firm order accepted by DISFRUTA TU BAÑO implies the buyer's acceptance of these General Conditions of Sale, regardless of the terms that may appear in the buyer's documents.

The specific conditions that may eventually repeal these General Conditions of Sale and Services are binding on DISFRUTA TU BAÑO if they have been expressly accepted in writing by the same.

The products will be billed at the prices in force in the rates established by DISFRUTA TU BAÑO which is available in the commercial documents.

Prices are indicated in Euros. All information included in this catalogue, as well as price lists, are indicative only and may change at any time without notice.

Shipping costs paid for orders of: a tap (all our taps include shipping costs); a piece of furniture, a shower screen, a shower tray or orders for spare parts and accessories with an amount greater than or equal to €95. For orders that do not meet any of these requirements, €12 will be charged for shipping.

Baño Total shipments will be made with postage paid to the peninsular level.

For shipments to the Balearic Islands: For all orders of bathroom furniture there will be a transport surcharge of €100 + (VAT 21%) while for the rest of the products in the store there will be a surcharge of €45 + (VAT 21%).

Shipments to homes are unloaded at doorstep or street level, so the carrier is not required to carry the material up or inside.

4.1- The items sold will be returned to the DISFRUTA TU BAÑO facilities at the buyer's expense and risk, including shipping costs.

4.2- It is the buyer's responsibility to check the shipments upon arrival and ensure that the goods have been delivered within the normal time and in good condition. Deliveries are made at street level.

4.3- Delivery times are for information purposes only and depend in particular on the availability of carriers and the order in which orders arrive. After 24 hours from receipt of the order, claims for possible breakages will not be accepted. A delay in delivery cannot compromise the responsibility of DISFRUTA TU BAÑO or be an excuse for penalties for damages.

4.4- The return costs will only be borne by DISFRUTA TU BA�O in the event of an obvious defect recognized by DISFRUTA TU BA�O.

4.5- Returns of opened or used products will not be accepted. Returns due to poor measurement or decision made by the customer will be subject to logistics costs, since these are very heavy products and transport costs are high.

5.1- Force Majeure: DISFRUTA TU BAÑO is not responsible for any failure to fulfil its obligations due to such delays or inability to deliver when this is due to causes of force majeure. Force Majeure shall be expressly considered, with the exception of those selected by the Spanish courts, delays or interruptions in transport for any reason, lack of availability or shortage of material, compulsory liquidation of one of its suppliers or subcontractors, blocking or interruption of means of communication, telecommunications and postal services, fire, flood, strike or partial, accident tools, new regulatory requirements or customs.

5.2- Liability for related products: DISFRUTA TU BAÑO is not liable for the product in the event of non-compliance with the storage and/or use conditions of the product defined by the applicable regulations, as well as the recommendations of DISFRUTA TU BAÑO. In general, if the defect is the result of an act attributable to the buyer, its employees, agents, contractors or subcontractors, DISFRUTA TU BAÑO will not be held liable.

6.1-Any dispute will be resolved in accordance with Spanish law in the courts of Valencia. DISFRUTA TU BAÑO reserves the right to modify the shape and finish of the products without prior notice for technical, commercial or aesthetic reasons.
